1. You and IcanFarm

• "IcanFarm," "we," "our," or "us" means the IcanFarm entity, headquartered in Singapore, that you contract with under these Terms.
• "You" or "your" means the person, organization, or entity browsing, accessing, uploading data, or otherwise utilizing the Platform. If you are utilizing the Platform on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. User Accounts and Authentication

To fully utilize the Platform—including managing garden plans, uploading images, or participating in the community—you must register a user account.

• Eligibility: You must be over the age of 18 to independently agree to these Terms. If you are under 18, you may only use the Platform with the explicit consent and supervision of a parent or legal guardian.
• Single Account Policy: To maintain the integrity of our community and AI data models, you are permitted to create only one user account. Your user account is personal to you and must not be transferred to anyone else.
• Security Responsibility: You are responsible for controlling who accesses and uses youraccount. You should not allow any other person to access or use your account and should not share your login details. You are responsible for all activity connected with your account, including data uploads and community interactions.

3. Acceptable Use and Restrictions

You agree to use the Platform safely, respectfully, and strictly for lawful agricultural management. You explicitly agree not to:

• Do anything misleading, offensive, illegal, or that infringes on the rights of others.
• Act abusively or disrespectfully toward IcanFarm employees, partners, customers, or other users.
• Modify, copy, adapt, reproduce, disassemble, decompile, reverse engineer, or extract the source code of any part of our platform.
• Use our platform to develop or provide any service that competes with us.
• Introduce or upload anything to our platform that includes a virus or other malicious code.
• Carry out any text mining, data mining, or web scraping of our platform without express permission.

4. Image Uploads and Bio-Security

We employ a dual-scope rule for image uploads depending on the feature you are utilizing:

• Community Posts: You may upload images containing human faces to the social community module, provided you have the consent of any individuals depicted. By doingso, you acknowledge these images will be publicly visible indefinitely unless removed.
• AI Plant Disease Diagnostics: When utilizing the AI disease inference tool or the organizational upload portal, you must not intentionally capture or upload images containing human faces, identifiable private property distinct from the agricultural subject, or sensitive personal data
• Bio-Security Compliance: Utilizing this Platform does not fulfill any legal obligation you may have to report agricultural outbreaks to relevant government authorities.

5. Artificial Intelligence Disclaimer

• No Professional Advice: The IcanFarm Plant Disease Inference Service utilizes artificial intelligence and machine learning to analyze uploaded plant images and generate diagnostic predictions and confidence scores. These AI-generated outputs are provided on an "as is" basis for informational purposes only.
• They do not constitute professional agricultural, botanical, or regulatory advice. IcanFarm makes no warranties regarding the absolute accuracy, completeness, or reliability of these AI predictions. You are solely responsible for evaluating the AI outputs and for any agricultural interventions, crop treatments, or financial decisions you undertake based on the Platform's data.

6. User-Generated Content, Advertising, and Intellectual Property

• Your License to Us: By creating, submitting, posting, or displaying user generated content on our platform, you grant us a worldwide license to use, modify, copy, distribute, publish, display, and create works based on such content anywhere in the world, without restriction or payment to you. This license allows us to make your contentavailable to other companies or individuals for syndication, distribution, promotion, or publication.
• Waiver of Moral Rights: You explicitly waive any claims and assertions of moral rightsor attribution against IcanFarm and its users with respect to your content.
• Platform Activity Data: We may collect and generate data relating to your use of our platform, including metrics, analytics, and information derived from your content and usage patterns ("platform activity data"). All rights to this data belong exclusively to us, and we may use it for any lawful purpose, including improving services and developing new features.
• Advertising: IcanFarm and its licensees reserve the right to display advertisements, paidcontent, and other commercial information near, or in association with, your content within the community or application. You are not entitled to any compensation for such advertisements, and the manner, mode, and extent of advertising are subject to change without specific notice to you.
• Our Platform Rights: Except as stated elsewhere in these terms, all intellectual propertyrights in our platform are owned by or licensed to IcanFarm.

7. Community Guidelines and Garden Sharing

• Community Visibility: The views expressed by users do not represent the views, values,or voice of IcanFarm. We may filter user generated content without notice if you breach or threaten to breach any of these terms.
• Garden Sharing Risk: Our Platform allows you to share comprehensive garden data—including highly sensitive physical locations, crop statuses, and images—with third parties via share tokens, deep links, or QR codes. You acknowledge that you utilize these sharing features entirely at your own risk. IcanFarm assumes no liability for theunauthorized dissemination, trespass, or misuse of your garden data resulting from links or codes you have generated.

8. Third-Party Services

The Platform relies on third-party integrations to function fully, including authentication providers (Google, Facebook) and external data services (such as Open-Meteo for weather and LocationIQ for geocoding). IcanFarm does not control these third parties and makes no guarantees regarding the continuous availability, accuracy, or reliability of the data provided by external services.

9. Disclaimer of Warranties

Our platform is provided "as is," without warranty of any kind. We cannot guarantee that our platform will be error-free or available at all times. To the extent permitted by law, we exclude all implied conditions, warranties, representations, or other terms that may apply to our platform.

10. Limitation of Liability

Except where restricted by law, in no event will we be responsible for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits. In no event shall our total aggregate liability to you in any circumstance exceed one hundred US dollars ($100.00).

11. Indemnification

To the extent permitted by law, you will indemnify us and our directors, officers, employees, andcontractors for any third-party legal proceedings (including actions by government authorities) arising out of or relating to your unlawful use of our platform or violation of these terms.

12. Termination and Suspension

If you repeatedly breach any of these terms, we may terminate or suspend access to your account, typically with reasonable notice. You may choose to delete your account at any time. In doing so, you will no longer be able to leave reviews on our platform, and all of your reviews will be deleted.

13. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to your use of the Platform shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the competent courts located in Singapore, and you consent to the exclusive jurisdiction of such courts.

14. Changes to These Terms

We can make changes to these terms at any time without notice. It is your responsibility to regularly check, read, understand, and agree to the most recent version of these terms, as any changes will immediately apply to you.
